These Terms of Sale apply to the purchase of goods from Ivory London Limited (“we”, “us”, “our”) through www.g-t.store

Please read these Terms of Sale carefully before placing an order. By placing an order through our website, you agree to these Terms of Sale.

We are a very small business, so need to protect ourselves from losses, so we can keep going.

Section 2 - General Terms

These Terms of Sale govern the sale of goods by us to you through our website.

These Terms apply only to purchases made by consumers. If you are buying goods in the course of a business, trade or profession, separate business terms may apply.

Nothing in these Terms affects your legal rights under applicable consumer law.

Section 3 - Eligibility to order

You may place an order through our website only if you are legally capable of entering into a binding contract.

You must ensure that all information you provide to us is accurate, complete and up to date.

Section 4 - Products

We try to ensure that all product descriptions, specifications, photographs and pricing are accurate.

However:

  • images are for illustration only;

  • colours may vary depending on your screen or device settings;

  • packaging may vary from that shown on the website; and

  • minor differences may occur between the goods delivered and their online presentation.

All goods are subject to availability. We do not guarantee that any item will always be available.

Section 5 - How the contract is formed

When you place an order, you are making an offer to buy the goods from us.

After you place your order, you will receive an acknowledgement email confirming that we have received it. This does not mean that your order has been accepted.

A contract between you and us is formed only when we send you an email confirming that your order has been accepted and dispatched, or otherwise expressly confirm acceptance.

We reserve the right to refuse or cancel any order before acceptance, including where:

  • the goods are unavailable;

  • we identify an error in the price or description;

  • we reasonably suspect fraud, unauthorised activity or misuse; or

  • we are unable to deliver to your location.

If we cannot accept your order, we will inform you and refund any sums paid as soon as reasonably possible.

Section 6 - Price and payment

The price of the goods will be the price shown on our website at the time you place your order.

Prices are shown in GBP and include VAT. Delivery charges and any other applicable charges will be shown to you before you complete your order.

You must pay for the goods and all applicable delivery charges at the time of placing the order using one of the payment methods made available on our website.

We take reasonable care to ensure prices are correct. However, if we discover an obvious pricing error, we may contact you for instructions or cancel the order and refund you.

Section 7 - Delivery

We will deliver the goods to the delivery address you provide during checkout.

We will aim to deliver within the timescale stated on our website or during checkout, but delivery dates are estimates only unless we have expressly agreed otherwise.

We are not responsible for delays outside our reasonable control. If there is a significant delay, we will try to contact you. You are responsible for ensuring that the delivery address is accurate and that someone is available to receive the goods where required.

Risk in the goods passes to you when the goods are delivered to the delivery address you provided. Ownership of the goods passes to you when we have received payment in full.

Section 8 - International delivery

We currently deliver only to addresses within the United Kingdom.

Section 9 - Your right to cancel

If you are a consumer and buy goods online, you generally have the right to cancel your contract within 14 days without giving any reason. For goods, this cancellation period normally expires 14 days after the day you receive the goods.

To exercise your right to cancel, you must tell us of your decision by a clear statement, for example by email to hello@g-t.store

Section 10 - Returns after cancellation

If you cancel your contract, you must send the goods back to us without undue delay and in any event no later than 10 days after the day on which you tell us you are cancelling.

We will pay the direct cost of returning the goods.

You must take reasonable care of the goods while they are in your possession. We may make a deduction from your refund for any loss in value resulting from handling the goods beyond what is necessary to establish their nature, characteristics and functioning.

Section 11 - Refunds after cancellation

If you cancel in accordance with section 9, we will refund you the price paid for the goods and the basic cost of standard delivery, if applicable.

We may make deductions from the refund as permitted by law, including for loss in value caused by unnecessary handling.

We will make the refund using the same means of payment you used for the transaction unless you have expressly agreed otherwise.

We may withhold the refund until we have received the goods back and they have been checked over.

Section 12 - Exceptions to the right to cancel

Your right to cancel may not apply to certain goods, including where applicable:

Goods made to your specifications or clearly personalised;

Sealed goods which are not suitable for return for health protection or hygiene reasons, if they become unsealed after delivery;

Goods which are liable to deteriorate or expire rapidly; and

Sealed audio, video or software products if unsealed after delivery.

Where an exception applies, this will be stated on the product page or at checkout where reasonably possible.

Section 13 - Faulty, damaged or misdescribed goods

We are under a legal duty to supply goods that are as described, fit for purpose and of satisfactory quality. Your rights in relation to faulty goods are governed by the Consumer Rights Act 2015 and cannot be excluded by these Terms.

If the goods you receive are faulty, damaged, or not as described, please contact us as soon as possible at hello@g-t.store with your order number and details of the issue.

Where you have a valid legal claim, you may be entitled to a repair, replacement, price reduction or refund depending on the circumstances and how long you have had the goods.

Nothing in these Terms limits your statutory rights.

Section 14 - Promotions, discount codes

We may offer discount codes, promotions from time to time. These are subject to any specific terms stated with the relevant offer.

Unless stated otherwise:

Discount codes cannot be combined;

Only one discount code may be used per order;

Discount codes have no cash value;

We may withdraw or amend promotions at any time before an order is accepted; and

Discount codes cannot be applied retrospectively to completed orders.

Section 15 - If we need to cancel your order after acceptance

We may have to cancel a contract after acceptance due to events outside our reasonable control, stock issues, pricing errors, or suspected fraud.

If we do, we will notify you and refund all sums paid for the affected goods. We will have no further liability to you beyond refunding the price paid and any delivery charges you paid for undelivered goods, except where the law provides otherwise.

Section 16 - Our liability

Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for:

Death or personal injury caused by negligence;

Fraud or fraudulent misrepresentation; or

Breach of your statutory consumer rights.

We are not responsible for losses that are not foreseeable. We supply goods for domestic and private use only. We are not liable for business losses, including loss of profit, loss of business, business interruption or loss of business opportunity.

Any limitation of liability in these Terms is intended to apply only to the extent permitted by law and must be read subject to your statutory rights. Consumer terms must be fair and transparent to be enforceable.

Section 17 - Events outside our control

We are not responsible for delays or failures caused by events outside our reasonable control, including strikes, transport disruption, accidents, severe weather, fire, flood, pandemic-related restrictions, supply chain disruption, or failure of communications networks.

If such an event occurs, we will try to notify you and take reasonable steps to minimise the effect.

Section 18 - Personal data

We will process your personal data in accordance with our Privacy Notice, available at [LINK TO PRIVACY NOTICE].

Section 19 - Reviews and user content

If you submit a review, comment or other material to us:

you confirm it is accurate and lawful;

you must not submit anything misleading, defamatory, infringing or offensive; and

you grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce and display that content for the purpose of operating and promoting our business.

We reserve the right to remove reviews or content at our discretion.

Section 20 - Changes to these Terms

We may update these Terms of Sale from time to time. The version in force at the time you place your order will apply to your contract with us.

Section 21 - Entire agreement

These Terms, together with any order confirmation, our Privacy Notice, and any other documents expressly incorporated by reference, form the entire agreement between you and us in relation to your purchase.

Section 22- Governing law and jurisdiction

These Terms are governed by the law of England and Wales / Scotland / Northern Ireland.

If you are a consumer, you may bring legal proceedings in the courts of the part of the United Kingdom in which you live, as applicable under relevant law.
